SPEAKER:  BARBARA BURKE, PH.D., ESQ,.

TOPIC: Legal and Ethical Considerations for Escrow Account Holders (1 Hour Ethics CLE)

SUMMARY:  This course will help title agency and law firm owners, managers, and escrow and trust account officers understand the pressures on account holders to protect the funds in those accounts. Legal and ethical considerations are reviewed, including using commercially reasonable security procedures and segregation of banking duties. Online banking concerns are also addressed, along with options that owners of a title agency or law firm could consider as ethical solutions for their customers.

SPEAKER'S BIO:  Barbara Burke has a bachelor’s degree in psychology from Vanderbilt University, Master’s and Doctorate degrees in Communications from Florida State University, and a law degree from Florida State University. Deciding that was enough school, she joined a law firm in Naples, Florida, representing condominium associations. A year later, she moved to Orlando and began working in the title insurance industry.

Since then, Barbara has been Claims Counsel, Underwriting Counsel, and Commercial Closing Manager for national title insurers, and General Counsel for a large Florida title insurance agency, focusing on residential and developer business. In 2002, she established her own company, consulting for affiliated business arrangements and providing education on title insurance issues through her Real Estate Law Series® company. In 2012, Barbara sold her company and joined First American Title’s Eagle Academy, creating online and classroom training programs for employees and agents nationwide. In 2016, she moved to the SE Region Education Department to focus on providing in-person and webinar education for agents.

Barbara is currently a member of the Florida Bar Real Property Section’s Title Insurance Committee after spending several years on the Bar’s Unlicensed Practice of Law and Ethics Committees. In her spare time, she volunteers for the Rotary Club of College Park, Florida, and the Adult Literacy League.
